By accessing or using PonyUp Performance, you agree to these Terms of Use. If you do not agree with these terms, do not use the website, tools, reports, or services.

2. PONYUP PERFORMANCE SERVICES

PonyUp Performance provides vehicle decision-support tools intended to help users evaluate financial and ownership decisions involving vehicles.

PonyUp may provide analysis relating to repairing, buying, selling, trading, or upgrading a vehicle. Services may also include vehicle specifications, VIN information, recalls, ownership information, estimates, recommendations, market information, and links to third-party resources.

PonyUp is a decision-support platform and is not a substitute for a professional mechanical inspection, professional diagnosis, legal advice, financial advice, insurance advice, tax advice, or other licensed professional services.

3. VEHICLE ANALYSIS

PonyUp analyses may use information supplied by the user, scoring models, estimates, vehicle data, market patterns, and information obtained from third-party sources.

Results may include decision scores, confidence scores, risk levels, recommendations, estimated values, repair-cost estimates, suggested purchase figures, or other decision-support information.

No PonyUp analysis guarantees the mechanical condition, reliability, safety, legality, future value, profitability, or suitability of any vehicle.

4. USER-SUPPLIED INFORMATION

Analysis quality depends partly on the accuracy and completeness of information provided by the user.

Users are responsible for reviewing important vehicle information and independently verifying facts before making financial or ownership decisions.

5. VIN AND THIRD-PARTY DATA

PonyUp may use government databases, third-party APIs, vehicle-information providers, market-data providers, and other external services.

This information may include VIN decoding, vehicle specifications, recalls, estimated values, title or accident information, taxes, fees, and other vehicle-related information.

PonyUp does not control third-party databases and cannot guarantee that third-party information is complete, current, accurate, or continuously available.

6. VALUES, COSTS, AND ESTIMATES

Vehicle values, repair costs, ownership costs, trade values, suggested purchase prices, auction values, and similar figures are estimates only.

Actual costs and values may vary due to vehicle condition, mileage, location, market conditions, configuration, labor rates, parts availability, taxes, fees, negotiation, and other factors.

7. ACCOUNTS

Some PonyUp services require a registered account. Users are responsible for protecting their account credentials and for activity conducted through their accounts.

Users may not use PonyUp for fraudulent, unlawful, abusive, deceptive, or unauthorized purposes.

8. PAYMENTS, PLANS, AND SUBSCRIPTIONS

PonyUp may offer free access, analysis credits, one-time purchases, recurring subscriptions, premium reports, and other paid services.

Pricing, included features, usage limits, billing periods, and renewal terms are those displayed at the time of purchase.

Recurring subscriptions renew according to the terms shown during checkout unless canceled.

Payments may be processed through third-party payment providers. PonyUp Performance does not directly store complete payment-card information.

9. THIRD-PARTY SERVICES AND LINKS

PonyUp may link to repair shops, parts suppliers, vehicle-value services, marketplaces, performance suppliers, and other third-party businesses.

Unless specifically stated otherwise, these links are provided for convenience and do not imply affiliation, sponsorship, or endorsement.

Transactions with third-party businesses are between the user and that third party.

10. SERVICE AVAILABILITY

PonyUp may modify, improve, replace, suspend, or discontinue features as the platform evolves.

Service may occasionally be unavailable due to maintenance, hosting providers, third-party APIs, network outages, security issues, or other circumstances.

11. INTELLECTUAL PROPERTY

PonyUp Performance branding, software, scoring systems, designs, reports, graphics, content, and other original materials are owned by or licensed to PonyUp Performance unless otherwise indicated.

Users may not copy, reproduce, scrape, reverse engineer, resell, republish, or commercially exploit PonyUp proprietary systems or materials without permission.

12. DISCLAIMER

PonyUp Performance provides information and decision-support tools for informational purposes. Results should not be treated as guarantees or as a substitute for independent professional evaluation.

Users remain responsible for deciding whether to repair, purchase, sell, trade, modify, operate, or otherwise act regarding a vehicle.

Users should independently verify information that could materially affect vehicle safety, ownership, legality, reliability, or financial value.

13. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, PonyUp Performance is not responsible for losses, damages, expenses, or other consequences arising from decisions made using information provided through the service.

14. CHANGES TO THESE TERMS

PonyUp may update these Terms as services, features, pricing, technology, or legal requirements change.

Updated Terms will be posted on this page with a revised effective date.
